Examples of sexual misconduct
Sexual harassment is a form of predatory sexual behavior in which a person targets another person or person(s). Harassment may take, but is no limited to, the following forms:
- Quid pro-quo harassment – something for something.
- Behavior that is severe, persistent/pervasive, objectively offensive, and interferes with the educational access, and/or creates a hostile environment.
- Retaliating against a person for refusing to “go-along” with harassment, including invoking consequences for reporting harassment, or refusing to be complicit in the observance of sexual harassment.
Non-consensual sexual contact is any intentional sexual touching, however slight, with any object, by a person upon another person that is without consent or by force.
Non-consensual sexual intercourse is any penetration, however slight, with any object, by a person upon another person that is without consent and/or by force.
Incapacitation is having sex with a person whom one knows, or should be known to be:
- Unable to make rational, reasonable decisions
- Having a mental disability
- Unconscious, asleep, or involuntarily restrained
- Under the influence of date-rape drugs
Sexual Exploitation takes advantage of another person and includes but is not limited to:
- Invasion of another person’s privacy
- Voyeurism
- Non-consensual digital, video, or audio recording of sexual activity or nudity
Relationship (Intimate Partner) Violence is any instance of violence or abuse – verbal, physical, or psychological – that occurs between those who are in or have been in an intimate relationship with each other.
Stalking is the repetitive and menacing pursuit, following, harassing, and/or interfering with the peace and-or safety of another. Forms may include but are not limited to:
- Lying in wait for another
- Monitoring
- Pursuing contact
